Major Media Coverage After Houston Judge Slaps Defense Firm with $102K Sanction for Discovery Abuses 

Attorneys at Kwok Daniel Ltd LLP have garnered significant media attention from The Texas LawbookTexas Lawyer, and ABC 13 following a landmark ruling by Judge Kristen Hawkins. The judge ordered the defense firm Wilson Elser to pay $102,627 in sanctions, the largest penalty of its kind that founding partner Rob Kwok has seen in more than 30 years of practice for “repeated discovery abuses” and “negligent misrepresentations”.  

These violations occurred during a catastrophic injury lawsuit involving a lifelong Houston Rockets fan who suffered permanent quadriplegia and a traumatic brain injury after tripping on a concealed steel grate while exiting the Toyota Center in 2022. The court held the law firm exclusively responsible for the misconduct, exempting their clients, Clutch City Sports and Rocket Ball Ltd., from the financial penalty.  

“Sanctions are not often found. Judges typically don’t do that, but when conduct arises to the level that is necessary for the court to send a message to the lawyers that sometimes can happen, and that’s what happened in this case,” said Ryan Loya with the Kwok Daniel Law Firm.
