Jackson Walker partner Phil Kim was featured in DH Insights discussing a federal whistleblower lawsuit filed by former Mayo Clinic director Traci Tamiko Eto that alleges the institution bypassed safety protocols and utilized manipulated data, including a 67% error rate, in deploying its MAYA AI digital assistant. The lawsuit claims that Mayo Clinic violated federal oversight regulations, jeopardized patient privacy with unauthorized genomic data sharing, and retaliated against Eto after she raised compliance concerns.  

Mr. Kim said, “the same access, the same minimum necessary obligations, the same audit or encryption obligations, all of those things that govern a human clinician, they still apply without exception to an AI system touching PHI.”
