Firm partner Chad Baruch of Johnston Tobey Baruch was featured in The Texas Lawbook’s Litigation Roundup after successfully representing the appellant, Abri Health Services. The Dallas Fifth Court of Appeals overturned a $785,000 judgment against the company, remanding a breach of contract lawsuit brought by former executives Tina Hecht and Paul Wray.
The appellate panel found a fact issue regarding Wray’s severance conditions and determined there was insufficient evidence to support attorney fees awarded to Hecht.
“Appellate review serves as a check on whether legal standards were met,” Baruch said in a statement. “In this case, the court recognized the evidentiary records didn’t support the summary-judgment relief awarded and remanded for further proceedings.”
