Shackelford partner Jake Pollack was recently featured in a Realtor.com article commenting on a legal battle that is unfolding in Jacksonville, Florida, where the Freedom at Arbor Mill homeowners’ association voted to pursue the eviction of 28-year-old TikTok influencer Bethany Michel from her late father’s home due to her age.  

In the article, Mr. Pollard said, “Ownership and possession of property can be separated (think of a landlord and tenant), and an heir generally inherits property subject to the same limitations, restrictions, and encumbrances that applied to the decedent. So the HOA may be correct that she owns the property but does not have a right to live there. The HOA regulations, the instrument by which her father acquired the property, and applicable law would be relevant to the determination.”
