A bylined commentary by Lynn Pinker Hurst & Schwegmann partner David Coale was recently featured in Salon.com. The article argues that the Supreme Court’s conservative majority applies “originalism” subjectively to serve political goals rather than as an objective method of constitutional interpretation.  

In his article, Mr. Coale explains that these shifting methodologies depend entirely on the desired conservative outcome. The article concludes that the justices’ self-proclaimed allegiance to originalism is guided by political results rather than neutral, objective jurisprudence.
