Veteran personal injury trial lawyer Ben C. Martin with the Dallas-based firm Ben Martin Law Group is addressing the lawsuits against the pharmaceutical giant Pfizer over the contraceptive drug Depo-Provera in with the publication Pharmaceutical Technology. Mr. Martin has been one of the most active attorneys in litigation filed over the health risks associated with this drug, primarily the link to an increased risk of meningiomas; these are tumors that grow from the membranes surrounding the brain and spinal cord.
Pfizer has long argued that the FDA prevented the company from adding a warning label on Depo-Provera. However, Mr. Martin tells the publication in the article, “FDA approves meningioma label warning on Pfizer’s contraceptive injection” that this may no longer be a feasible argument since the FDA has now began enforcing a meningioma label warning, “This ‘impossibility’ pre-emption argument should now fail given that a warning was not only possible but that the FDA is now requiring such a warning.”
