An Olson Grimsley trial team was featured by several local and national media outlets including Law 360, Reuters, The Chicago Tribune, and the Chicago Sun-Times, after an Illinois jury ordered Abbott Laboratories to pay $70 million to four families, finding that the company’s cow’s milk-based formula Similac caused premature infants to develop necrotizing enterocolitis (NEC).
The verdict includes $53 million in compensatory damages and $17 million in punitive damages, with the jury finding that the company failed to adequately warn of the risks, prompting the company to announce plans to appeal.
“This verdict reveals the truth that Abbott hid from the public: cow’s milk-based baby formula causes NEC in premature infants,” said Olson Grimsley partner Sean Grimsley. “No amount of money can help these families recover from this terrible disease, but today’s verdict provides a measure of justice for families who were kept in the dark.”
