Bloomberg Law, The Daily Reporter, Law 360, and the Milwaukee Journal Sentinel featured comments from attorney Jonathan Holder with the Dallas-based law firm Dean Omar Branham Shirley after the Wisconsin Supreme Court upheld a jury verdict that found Pabst Brewing Co. liable for the asbestos-related death of a contractor. The ruling affirms that property owners have a non-delegable duty under the state’s Safe Place Statute and that companies are responsible for dangerous conditions, such as asbestos, even when work is performed by independent contractors.
“This decision builds on what both the jury and the appellate court already recognized: Pabst knew about the dangers of asbestos exposure in its facility and failed to act,” said Mr. Holder, counsel for the plaintiffs. “The Wisconsin Supreme Court has now made clear that companies cannot avoid responsibility for unsafe conditions simply because the work is performed by contractors.”
