Gov. Abbott’s plans for a specialized business court system would erode the jury system

“With Delaware as his North Star, Texas Gov. Greg Abbott recently released a list of state budget priorities that includes the creation of a specialized business court system. At first glance, the establishment of such courts, with trials conducted without juries, would theoretically attract more corporations to Texas and help to clear the backlog of cases in our civil courts, which has only been exacerbated by the COVID-19 pandemic.
Although these concerns are entirely valid and certainly worthy of our government’s attention, I believe the creation of specialized business courts would further erode the jury trial system, one of our most prized and cherished institutions.”
