Law360 recently reported on a proposed class action filed in Colorado federal court accusing U.S. Immigration and Customs Enforcement (ICE) officials of conducting illegal, warrantless arrests across the state.
The lawsuit was filed on behalf of four Colorado residents by Olson Grimsley Kawanabe Hinchcliff & Murray LLC, together with the ACLU of Colorado and the Meyer Law Office.
In the article, Olson Grimsley partner Kenzo Kawanabe emphasized that the plaintiffs are seeking an injunction to stop ICE’s unlawful actions. “We’ve asked the court to issue an injunction doing a number of things, but first and foremost that ICE has to follow the law,” he told Law360.
The suit, which also names Homeland Security Secretary Kristi Noem and senior ICE officials, alleges that ICE agents violated the Immigration and Nationality Act by arresting individuals without warrants or proper flight-risk evaluations.
The case, Ramirez Ovando et al. v. Noem et al., underscores a growing legal challenge to immigration enforcement practices in Colorado.
