A version of S.B. 45 was introduced during the 2019 legislative session, but died on the calendar after passing through the senate affairs committee. Stewart Hoffer, a partner at Hicks Thomas LLP, said he was “shocked” when a colleague on the plaintiffs’ side of the bar told him that the bill had become law this session. “It’s surprising that Texas, given the Legislature we have and the governor we have … and the kind of active tort reform lobby we have, that this flew under the radar and passed,” he said. “But I think everybody, regardless of political leanings, can get behind the notion that the workplace should be free from any sort of discrimination or harassment.”
