Martin and Caio Formenti with the Dallas-based personal injury firm Ben Martin Law Group are highlighting what Texas law has to say regarding court-appointed guardians ad litem in a bylined article for Texas Lawyer titled “What Are the Duties of a Guardian Ad Litem in Texas?” Guardians ad litem are individuals who are chosen to represent the best interests of a minor in legal proceedings such as custody disputes and cases involving abuse or neglect.
The article reads in part, “Though the guardian ad litem’s essential duty is limited to an advisory role to determine whether a proposed settlement is in the best interest of the minor, Texas courts have recognized that the guardian ad litem nevertheless owes the party a fiduciary duty in this limited role, subjecting the guardian ad litem to liability in the event of a breach.”
