Burns Charest partner Dan Charest is quoted in Texas Tribune article “A Texas landowner can sue the state for flood damage to his property, U.S. Supreme Court rules.”
Mr. Charest brought the original suit back in 2020. “It’s great for our clients, and great – frankly – for the citizens of Texas,” Mr. Charest told the Tribune.
The U.S. Supreme Court ruled unanimously that a Texas Landowner may seek compensation from the state for damages to his property east of Houston.
Mr. Charest was also featured by The Texas Lawbook about his experience attending the oral arguments back in January.
“The Texas solicitor general said you can bring this claim under Texas law,” Charest told the legal publication. “I wrote down at that moment ‘We just won.’ That’s all we needed.”
