Burns Charest partner Matt Tripolitsiotis was featured in a Law.com article after the U.S. Supreme Court declined to hear AviaGames Inc.’s petition, leaving intact lower court rulings that deemed the company’s arbitration agreement invalid. The SCOTUS denial allows a consumer class action to proceed in federal court. The lawsuit alleges AviaGames rigged online tournaments by using bots, rather than human competitors, with plaintiffs alleging over $1 billion was wagered under false pretenses.,
Mr. Tripolitsiotis said, “And since bringing the case, we’ve been contacted by many of our class members, and they confirmed to us some really horrible stories of losing six figures or more,” he said. “There’s some really bad stories about people who thought, ‘If I just get better, I’ll make up my losses.’ They didn’t realize they were at a casino and not at a skills competition.”
