Clay Mahaffey of Burns Charest LLP recently spoke to Law360 regarding a Fifth Circuit decision involving Southwest Airlines and a controversial court-ordered religious liberty training.
The Fifth Circuit struck down a Northern District of Texas judge’s order that would have required several in-house attorneys at Southwest Airlines to undergo religious liberty training, calling the remedy ineffective in compelling compliance. The order followed a wrongful termination suit filed by former flight attendant Charlene Carter, who alleged she was fired for sending anti-abortion messages to her union president.
Mr. Mahaffey told Law360 that the ruling reflects a broader judicial shift.
“It doesn’t take a rocket scientist to see that the case is part of a trend of more heavily scrutinized injunctions, especially after the U.S. Supreme Court’s decision this term limiting nationwide injunctions,” he said.
