Managing Shareholder Chad Baruch argued that a calendaring mistake caused a motion for summary judgment response to be filed one day late. The appellate court agreed, finding no harm to the other party, and reversed the trial court’s refusal to accept the late filing, deeming it an abuse of discretion.
